Welcome to Nocotine (the “App”), operated by Pier94 Talent LLC (“we,” “us”). By downloading, accessing, or using the App you agree to these Terms. If you do not agree, do not use the App.
Nocotine is a self-help tracking and motivation tool to help you monitor and reduce nicotine use. It is NOT a medical device, medical treatment, or healthcare service, and it does not diagnose, treat, cure, or prevent any disease or condition.
All content, plans, estimates, and figures in the App (including nicotine amounts, chemicals, origin, costs, savings, lifespan, and health information) are for general informational and motivational purposes only and are not medical, health, financial, or professional advice. Always consult a qualified healthcare professional before making decisions about nicotine use, cessation, or your health, and never disregard professional advice because of anything in the App.
Quitting or reducing nicotine is difficult and highly individual. We make no guarantee, representation, or warranty that the App will help you quit, reduce use, or achieve any particular health, financial, or other result. Outcomes depend on many factors outside our control.
Nocotine exists solely to support reduction and cessation. Nothing in the App is intended to promote, encourage, endorse, advertise, or facilitate the purchase or consumption of nicotine, tobacco, or vaping products. Any product information (such as nicotine content or ingredients) is provided only for awareness and tracking, never as a recommendation to consume.
You must be at least 18 years old, or the minimum legal age to purchase nicotine products in your jurisdiction if higher, to use the App.
Product recognition, nicotine content, chemical, origin, cost, savings, streak, and health figures are estimates and may be inaccurate or incomplete. Do not rely on them as fact; you are responsible for verifying anything important to you.
You consent to our collection, use, and sharing of information as described in our Privacy Policy. This includes using your information to operate and personalize the App and to perform analytics, research, and to develop, train, and improve our products, services, and models. You also agree that we may create, use, sell, and share aggregated or de-identified information (which cannot reasonably identify you) with third parties for any purpose.
The App offers auto-renewing subscriptions billed through your App Store account. Payment is charged at confirmation of purchase. Subscriptions renew automatically unless canceled at least 24 hours before the end of the current period, and you manage or cancel them in your App Store account settings. Prices may change with notice. Except where required by law, payments are non-refundable.
You use the App at your own risk. To the maximum extent permitted by law, the App is provided “as is” and “as available” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. To the maximum extent permitted by law, we and our affiliates, officers, employees, and providers will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of health, profits, savings, or data, arising from or relating to the App, even if advised of the possibility. Our total liability for any claim will not exceed the amount you paid us in the three months before the claim.
You agree to indemnify and hold us harmless from any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising from your use of the App or your violation of these Terms.
We may modify the App or these Terms at any time. Your continued use after changes take effect means you accept them.
These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict-of-law rules.
